Agreement to Terms

By accessing or using Vokna's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services. These terms apply to all users of Vokna's AI-powered text-to-speech platform and related services.

Eligibility

You must be at least 18 years old to use Vokna's services. If you are under 18, you may only use our services with the consent and supervision of a parent or legal guardian.

If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Description of Service

Vokna provides a professional text-to-speech platform that converts your text content into high-quality, natural-sounding audio using advanced neural networks. Our platform includes various features such as:

55 AI voices across 9 languages with various accents and speaking styles
Speaker creation and management for multi-voice projects
Project organization with sections and segments
High-quality MP3 and WAV audio generation and export capabilities
Real-time voice generation powered by neural network models
Character-based usage tracking and billing
Commercial and personal use licensing options on paid plans

Specific features, voice counts, language availability, and plan details are subject to change and are detailed on our website. Our voice synthesis models are continuously improved through machine learning techniques, and we may update our technology to enhance audio quality and add new features.

User Accounts

Account Creation

To access certain features, you may need to create an account. You are responsible for:

Providing accurate and complete information
Maintaining the security of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access
Not sharing your account with others

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in prohibited activities, or for any other reason at our discretion. Upon termination, you will lose access to all content and features associated with your account.

Content and Usage Rights

Your Input Content

You retain ownership of the text content you provide to our services. By using Vokna, you grant us a limited, non-exclusive license to process your content for the purpose of generating audio output and improving our voice generation services.

Generated Audio Output

Subject to your compliance with these terms and our usage policies, you own the audio files generated from your content. However, you acknowledge that:

The underlying AI models and technology remain Vokna's property
You must comply with all applicable laws when using generated audio
You are responsible for ensuring you have rights to the input content
Commercial use may require appropriate subscription plans

Voice Model Training

We may use aggregated, anonymized data from our services to improve our voice synthesis models and develop new voices and features. We do not use your personal text content or generated audio for training without your explicit consent, except as necessary to provide and improve our services.

Acceptable Use

Permitted Uses

You may use our services for legitimate purposes including:

Creating audiobooks, podcasts, and video content
Educational materials and e-learning courses
Personal storytelling and creative projects (Free tier)
Commercial content production (paid plans include full commercial licensing)
Marketing materials, advertisements, and YouTube videos
Accessibility applications and assistive technology
Content localization and multilingual voiceovers
Game development, apps, and interactive media

Prohibited Uses

You may NOT use our services to:

Create content that infringes on others' intellectual property
Generate harmful, defamatory, or illegal content
Impersonate others without explicit permission
Create deepfakes or misleading audio content
Violate any applicable laws or regulations
Circumvent usage limits or technical restrictions
Generate content for harassment or abuse
Create content that violates platform policies of third-party services

Payment and Billing

Our pricing is based on a character-based system with monthly subscription plans. Characters are consumed when you generate audio from your text - 1 character equals 1 character of text converted to speech. We offer three service tiers (Free, Starter, and Professional) with different monthly character allowances, voice processing quality, and features as detailed on our pricing page.

Current pricing includes: Free tier (10,000 characters/month, personal use only, no credit card required), Starter ($5.99/month, 50,000 characters with commercial license, overage at $0.99/10k characters), and Professional ($19.99/month, 250,000 characters with commercial license, overage at $0.79/10k characters). Free tier allows up to 6 speakers total; paid plans include unlimited speakers. All plans include access to all 55 AI voices across 9 languages.

Billing Terms

Charges are based on characters consumed for text-to-speech generation
Free tier resets to 10,000 characters at the start of each calendar month
Paid subscriptions renew automatically unless cancelled
Overage charges apply if you exceed your monthly character limit on paid plans
We reserve the right to change pricing with 30 days advance notice
Professional subscribers receive GPU-accelerated processing for faster audio generation
All fees are non-refundable except as specifically stated in our Refund Policy
Unused monthly characters do not roll over to subsequent billing periods

Payment Processing

Payments are processed through secure third-party payment processors. You authorize us to charge your selected payment method for all fees incurred. If payment fails, we may suspend your account until payment is resolved.

Fair Use Policy

Vokna strives to provide equitable access and high-quality service to all users. While we offer generous character allowances and features like unlimited projects, our services are subject to a fair use policy to ensure system stability and consistent performance for all users.

This policy is designed to prevent abuse, maintain service quality, and ensure sustainable operation of our platform. We reserve the right to apply reasonable limitations or take appropriate action (including rate limiting, temporary suspension, or requiring an upgrade) in cases of excessive usage that negatively impacts our systems or other users. Examples include automated bulk processing, API abuse, or sustained usage patterns significantly exceeding typical use for your subscription tier.

Factors that may indicate excessive or non-standard usage include, but are not limited to, unusually high volumes of concurrent requests, sustained peak usage that significantly exceeds typical patterns for your subscription tier, or activities that could be detrimental to our infrastructure. We will endeavor to notify users before taking action whenever possible.

Refund Policy

Subscription Refunds

We offer refunds under the following specific circumstances:

Free Tier: Our Free tier (10,000 characters/month) requires no credit card and has no charges
New Subscriber Guarantee: First-time paid subscribers may request a full refund within 7 days of their initial subscription
Service Failure: If our service is unavailable for more than 24 consecutive hours due to technical issues on our end
Billing Errors: If you were charged incorrectly due to our billing system error
Fraudulent Charges: If you can demonstrate unauthorized use of your payment method

Non-Refundable Items

The following are not eligible for refunds:

Characters used for audio generation after processing is complete
Overage charges for usage beyond monthly character limits
Subscription fees after the initial 7-day refund period (except for service failures)
Unused characters at the end of a billing cycle
Refunds for partial months or unused portions of subscriptions

Refund Process

To request a refund:

Contact our support team within the applicable refund period
Provide your account information and reason for the refund request
Allow 5-10 business days for review and processing
Refunds will be issued to the original payment method

We reserve the right to deny refund requests that do not meet our policy criteria or that we determine to be fraudulent or abusive.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time. No refunds will be provided for the remaining portion of your subscription period.

Data Privacy and Security

We take data privacy and security seriously. Our Privacy Policy details how we collect, use, and protect your information. Key points include:

Your content is processed securely and not shared with third parties
We retain data only as long as necessary to provide services

Service Availability and Performance

We strive to maintain high service availability but do not guarantee uninterrupted service. We may temporarily suspend service for:

Scheduled maintenance and updates
Emergency security measures
Circumstances beyond our reasonable control
Compliance with legal requirements

Voice generation times may vary based on server load. Professional subscribers receive GPU-accelerated processing for significantly faster generation times. All tiers use the same high-quality voice models. Tiers differ in character allowances, processing speed, commercial licensing, and overage rates as detailed on our pricing page.

Intellectual Property

Vokna's Rights

Vokna and its technology, including AI models, software, user interface, and documentation, are protected by intellectual property laws and remain our exclusive property.

Infringement Claims

If you believe your intellectual property rights have been infringed, please contact us immediately with detailed information about the alleged infringement. We will investigate and take appropriate action in accordance with applicable laws.

Disclaimers and Limitations

Service Disclaimers

Our services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Vokna shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

Loss of profits or business opportunities
Data loss or corruption
Service interruptions or delays
Third-party claims or actions

Our total liability to you for any claims related to our services shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Vokna and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through our platform with at least 30 days advance notice for material changes. Continued use after changes constitutes acceptance of the new terms. If you do not agree to the changes, you must stop using our services.

Governing Law and Disputes

These terms are governed by the laws of the jurisdiction where Vokna is incorporated, without regard to conflict of law principles. Any disputes arising under these terms will be resolved through binding arbitration, except for claims that may be brought in small claims court.

By using our services, you waive your right to participate in class action lawsuits or class-wide arbitration against Vokna.
